Dear Governor Arnold Schwarzenegger:
The California Assembly passed SB 17 on a majority vote on June 28th 2009 which contains a provision for a 3% withholding tax on independent contractors. If this bill becomes law, and you are in California your company will be required to withhold 3% of your monthly check and send this amount to the State of California.
I oppose this bill because we believe that direct sellers, as well as other independent contractors, should continue to be exempt from withholding taxes due to their deductable business expenses. This legislation could potentially set a negative precedent that other states and even the Federal Government could follow.

Dear Governor Arnold Schwarzenegger:
I strongly urge you to VETO SB 17! California has an estimated 500,000 Internet Marketers who are Independent Contractors that would be affected by the 3% withholding.
Many of them will just change their address to another state, thus depriving California of more tax revenue. They can also terminate thier contract (as a California Resident) and sign up a new contract in another state. Electronically this will take them only a minute or so. The parent Direct Sales Affiliate Company will be perfectly innocent. The Independent Contractor, Affiliate, Internet Marketers will see their action as a revolt against states trying to control the Internet. THIS IS CALLED THE LAW OF UNINTENDED CONSEQUENCES that Legislative politicians often ignore.
Whoever came up with SB 17 does not understand (or did not do due diligence) about the Internet or the “Powerhouse” California is in Internet Marketing by individual independent contractors.
The Compliance (law enforcement) costs I estimate (as an experienced Internet Marketer) will be 10x the revenue brought in. The only way to fix this would be exempt direct selling companies using independent contractors from SB17 requirements.
