IMAGINETIX VS NIKKEN LAWSUIT $10 MILLION GOES ON LIKE SOAP OPERA
1. First the little guy Imagenetix sued Nikken for Patent violations. Then August 15, 2011, Imagenetix filed a voluntary dismissal with the district court for nine of the ten defendants (including all of the individual distributors and all of the Nikken officers, employees, product developers, and product spokesmen), and then got the district court to stay the entire lawsuit pending the patent re-examination in #3 below with the PTO Board and Three judge panel.
2. Nikken news release. We are pleased pleased to announce that on January 12, 2012, the United States Patent and Trademark Office (“USPTO”) reexamined Imagenetix’s patent, U.S. Patent No. 5,569,676, and rendered its final decision, rejecting Imagenetix’s patent claims. The USPTO found that Imagenetix’s supporting declarations were insufficient and its arguments were misdirected. Ed. Note: Whoops!! see next paragraph
3. Per appeal by Imagenetix U.S. PTO Board and Three judge panel reverses rejection above in #2 June 2013
4. November 25 2013 Imagenetix submits case reinstatement against Nikken in U.S. FEDERAL DISTRICT COURT OF CENTRAL CALIFORNIA. ED NOTE: We will keep you posted!
