Chefs are setting aside their meat cleavers for garden gloves and focusing on vegetable-based dishes. With so many interesting new options, such as mangosteen & red celery, who can blame them? One of the biggest boosters is superchef and “Meatless Monday” proponent Mario Batali. At Eataly, his new megastore, there’s even a “vegetable butcher” to prep produce and advise customers on, for instance, how to prepare a mean swiss chard.
Editors Note:  This was a confusing article, it didn't say how many bottles of Xango it took to make red celery?  Will it work for my aloe vera plants?  What do I feed them?  A case of Xango a week?  Help!


NEW VISION AND XANGO SQUARE OFF IN LAWSUIT
XANGO SUES NEW VISION FOR PATENT INFRINGEMENT

New Vision has been selling a product called "Essential Vitamins Plus Mangosteen" for the last several weeks.  On May 4th Xango was issued a patent (#6730333) on the "composition" of their Mangosteen product.  On May 4th Xango filed a patent infringement suit against New Vision (District Court of Utah, case #2:04cv00405).

Commentary:   This should be an interesting case to follow.  The patent is actually a "process" patent that attempts to protect Xango from others who would combine the Mangosteen pericarp (rind) with "other juices."  The rind is said to contain a higher amount of "Xanthones," the active substance that is most responsible for the myriad alleged health benefits.  It's also the same active substance in Noni (as well as other more common fruits, such as Pineapple).

With the success of Xango it was inevitable that Mangosteen based products would start popping up all over the MLM industry.  Since it appears Xango believes they have tied up the rights to mix the Mangosteen rind with ANY other juice, it was therefore inevitable they were going to sue somebody.

WATCHDOG OPINION
ROD’S OPINION --- PROCESS PATENTS HERE TO STAY!
In July of 1998, the U.S. Court of Appeals for the Federal Circuit  issued a decision that changed the world of patents. The case, State Street v. Signature Financial, involved software that Signature had written to enable it to administer mutual funds more efficiently. But the court’s language was broad enough to embrace any business process (as long as it was new and “nonobvious” and had a “useful, concrete, and tangible result”).  Pardon Len he is just catching up with the times.

The FLOOD GATES opened, and in the past five years thousands of business-method patents have been granted.   I am a biased on the subject because I have been involved in researching and drafting business process patents for Israeli and American Internet companies.  

In fact I am now letting the wraps off a deep secret.  I have filed a business process patent for “MLM Time” were it seems there are only 20 hours to a  in a day when trying to build a downline.  The details for the watches, calendars and contact managers are secret but this article on Roku (Rock U) the inventors of the DVR will give you a hint!  It’s prior art does not infringe on my patent pending
