LIFE PLUS LOSES TERMINATION APPEAL
18 Jan 2003 - Life Plus terminated the Browns resulting in the case "Life Plus International vs. Wayne Brown, Fran Brown" Well, at the end of the trial, the jury awarded Fran Brown $245,000. including $180,000 in punitive damages in May 2001. Life Plus proceeded to appeal that verdict. On Wednesday, January 15th 2003 the United States Court of Appeals upheld that verdict. Life Plus lost the appeal. Of course, the Browns are sure they will appeal again..to the Supreme Court. Anything to drag it out and rack up more attorneys fees, but this is very good news not only for us, but for anyone else who may be now or in the future involved in a lawsuit with Life Plus or any other network marketing company.
In the appeal, Life Plus argued that the punitive damages of $180,000 was excessive. This is quoted directly from the appeals court opinion filed on Jan. 15th, 2003... "The undisputed evidence shows that Life Plus withheld more than $11,000 in checks from Fran. On this evidence, a punitive damages award of $180,000 was not unreasonable, and no miscarriage of justice occurred.
$11.2 million verdict against Mary Kay Inc.
25 Nov 2002 - A former star cosmetics saleswoman who says Mary Kay Inc. fired her when she was pregnant and battling breast cancer won an $11.24 million jury verdict Thursday from the giant beauty products firm. Claudine Woolf, 33, of Walnut Creek, who claimed that Mary Kay refused to cut her $8,000-per-month sales quota even though she was battling to save her own life and that of her unborn baby, won the verdict after a two-week trial in Dallas, said her lawyer, Angela Alioto. June 2002 - Richard and Tammie Fugo worked Starlight between April 1996 to August 14, 2000 when they got a fax from the company telling them they were terminated. In four years the Fugos have worked themselves up to Emerald (over $3000 a month) and were just a step away from the top position of Diamond. The fax they received told them they were being terminated for "Ethics" violations like being too bossy to their downline ( See Reasons for MLM Terminations - Viperours Upline)! Fugos attorney asked for $1.3 million based on the age and earnings expectations of the victims. Starlight also pointed out that the Fugos had lost money first 3 out of four years they had been in Starlight and that there wasn't any residual income for the future. (Ed. Note: bet that is not what the company says when recruiting). The logic of spending money and working hard to build a future won the day! The Jury loved it and gave Fugos $50,000 for lost earnings and $600,000 for future earnings. Of course, Starlight says they will appeal the case.

PartyLite
Sept 2000 - After 9 years with PartyLite, Group Leader, Marilyn Pokrak, had her account closed. There was no reason given by PartyLite for the termination. Since Marilyn did not knowingly violate any PartyLite rules, she has no idea why she was terminated. PartyLite used a clause on the back of their consultant agreement known as the "10 day clause." This clause states that either party can terminate the contract in10 days for any reason. Marilyns' unit, consisting of approximately 30 active consultants, received a letter from her Senior Regional Vice President on Feb. 9th, 2001. The letter stated "that for personal reasons Marilyn was no longer with PartyLite." Marilyn received no notification from PartyLite or her Senior Regional Vice President.
Marilyn immediately called PartyLite. They said she was reduced to the consultant level. After many attempts to get to the bottom of the situation, on Feb. 14, 2001, Laurie Lawrance, of PartyLite, left a voice mail stating that Marilyns' account had been closed and she knew it. She stated that Marilyn had received a letter of notification and the topic was not open for discussion. After repeated demands, on March 2nd Marilyn did finally receive the form termination letter.
Marilyn became a consultant in March of '92, she was a consistent bonus earner, She became a unit leader within 6 months. After working her way up methodically through the ranks, on Jan 1, 1999 Marilyn was promoted to Regional Vice President. She held that rank for nine months.
Marilyn opened a Web Site to alert others of her and other 10-day clause terminations. The web site is forum based. Soon after, she received a letter from Blyths' attorney accusing her of defamation. The web site http://www.TheHypeOfIt.com is still up and running. It is currently receiving over 44,000 hits per month and has reached the top positions on many major search engines.
