A: get the true story before you blast seasilver. looks like a distributor took advantage of this guy not seasilver. seasilver never did radio also no front loading. the guy is stupid. and I hope seasilver sues you for insaboardanation.
Editors Reply: For all uneducated Sea Silver distributors like Mike above. An MLM Company is responsible for all the scams that their distributors pull. Sea Silver NEVER did radio? Mike are you drinking purple kool aid! They allowed…… and thus approved the radio investment scheme outlined in the article below. OHHHH the company never did radio that is the most stupid statement I have ever heard! The company compensation plan encouraged BACK END loading which is the reference I made to 2XP and the FTC. That was a major issue when the FTC hit 2XP out of Dallas. Is it your theory then that Dr. Freidman and Brett Radamacher (who were also named in the FTC legal action) be the only ones that are held responsible since they set up the radio ad scheme? FAT CHANCE if you think Sea Silver and the owner didn’t know about the radio investment scheme! Sea Silver is where the buck stops!!!
Sue the MLM WatchDog for what? First learn to spell, then use the right word! The Truth is hard to sue about! We have an accountant provided 3 pages that is hard to refute! Plus 30 pages of documentation to and from Sea Silver minions backing it up! Selling an Investment in radio and product (plus why did Harvey have to buy product? The radio ads went to an 800 number and Sea Silver shipped)!
I have forwarded your real email address to Harvey. He can sue you for calling him stupid (he is not) and the court case against you will be slander. Meantime I will assume that you are speaking for the company since they are responsible for for all that distributors do.....................UPDATE: Ahh ha just got more complaints and 2 pro Sea Sliver Distributors. Which reminds me what Sea Silver allowed was Illegal in Florida (Business Opportunity Law) and in Sea Silvers home state (Seller Assisted Marketing Plan). Both States require filing with the state as a biz opp and full disclosure documents if over $600 is to be spent in six months.

27 Jan 2003 -- The WatchDog was investigating Sea Silver for Price Fixing. The FTC hit them for illegal claims for their product (see below) and shut Sea Silver down. Now acting on a complaint received by the WatchDog we find out they were doing an investment pyramid scam. Fortunately it was in Tampa, Florida and we had a skilled Senior Investigative Reporter there.
Sea Silver would get people to put up thousands of dollars for radio advertising (some of which turned out to be a scam) and buy tons of product based on making “tons of money.” The problem is that according to our investigation at this point some (many?) people may have lost money on investing money into the advertising pyramid scheme. Spend your life savings, sell product and build a downline, get rich! Throw in letting radio ad brokers steal money and you have a well rounded scheme. Oh and don’t forget the $99 CDroms with the radio scripts on them also sold by Dr. Friedman and his ad group. What a scam! The only problem seems to be the earnings didn't match expenses!
That's what hit Harvey Kirby as he filed bankruptcy, his life savings destroyed by Sea Silver. $21,000 in the hole from following this “almost guaranteed” way to make money. Talk about “Elder Fraud” in America and the vultures that prey on them. It appears that the FTC may have hit Sea Silver for 1/2 of the wrong things!!

WatchDog Senior Reporter Denny Elkins checking numbers from accountant and preparing over 14 packages for mailing to get Sea Silver halted. How the FTC could have missed this is hard to understand. Of course it took almost two years after complaints were sent in for the FTC to do anything about 2 Extreme Performance out of Dallas. By that time the 2XP crooks had hid the money offshore, sold that company and left a mess. Let's see if the FTC can do better on this fraud since it is in their hands right now!

16 July 2003 -- Sea Silver Update Regarding FTC and FDA Legal Actions; Tentative Plans to Resume Operations
Although Seasilver still faces challenges, we can report to you the Company has made significant progress in its efforts to resolve the legal actions brought by the FTC and the FDA and to resume operations.
FTC Action
The Company has reached agreement with the FTC on the terms of a Stipulated Preliminary Injunction which has been approved by the federal judge in Nevada. The Stipulated Preliminary Injunction adopts all the terms of the previous TRO, including the order that Seasilver and its business associates shall not make any unsubstantiated claims as to the health benefits of the product. The Receiver also remains in place. Bela and Jason Berkes are cooperating with the Receiver and assisting in the company's efforts to resume operations under the direction of the Receiver.
FDA Action
The Company's attorneys are continuing discussions with the FDA to resolve the FDA's objections to the Company's product labeling. The Company will not, under any circumstances, sell or ship any Seasilver product until we have a label which complies with all applicable FDA regulations.
Resumption of Operations
Under the terms of the Stipulated Preliminary Injunction, the Company may resume operations, include selling and shipping product, so long as we are in compliance with all the terms of the Preliminary Injunction. We are now finalizing operational contingency plans under which we would tentatively bring back a portion of our workforce by Friday, July 18, 2003 and resume the taking of orders on or about Monday July 21, 2003 with product to be shipped within 5-10 days after that.
When we do resume operations, we will institute careful procedures to permit customers to cancel existing orders or to secure refunds for returned product. No customer will be permitted to place a new order without acknowledging that he/she has read or heard a Notice required by the Preliminary Injunction. When we resume, we will also implement a compliance program, which will subject any Business Associate who engages in any unauthorized advertising to immediate termination.
You Must Cease and Desist from Making any Health Claims on the Product.
The Preliminary Injunction imposes the same requirements on the Company and all its Business Associates as did the TRO. As you were previously advised, you must cease and desist from making any false or misleading statements or representations in connection with the marketing, distribution or sale of any Seasilver product, specifically including but not limited to representations that Seasilver cures or treats cancer, enables 9 of 10 diabetes patients to stop insulin, leads to weight loss without dieting, treats or cures typhoid or anthrax, is proven to be non-toxic, and/or provides any other health benefits without competent and reliable scientific evidence.
You Must Cease any Use of the Current Seasilver Product Brochures - As you were previously advised, we have recalled all packaging and labeling including all descriptive materials and brochures which contain any representations as to the health benefits of Seasilver. This specifically includes the current Seasilver brochure entitled Seasilver USA/The Leader in Foundational Health. If you have copies of that brochure, please do not use them for any purpose, and immediately return them to the Company. If you have any copies of a booklet entitled "Journey into the World of Foundational Health", you must return them immediately.
You Must Terminate Any Other Marketing Activities That are Not Approved by The Company - As you were previously advised, you must terminate any marketing activities of any kind, including websites, which use materials or make claims that have not been approved by the Company. If you have any such materials in inventory, you must destroy them immediately. Please refer to the Policies & Procedures adopted by Seasilver. Paragraphs 15 and 17 expressly prohibit any Independent Business Associate from advertising or offering for sale Seasilver Dietary Supplement in any way other than through the advertising and promotional materials made available by the Company, or except as otherwise expressly approved and authorized by the Company in writing before any dissemination, publication or display. Failure to abide by these procedures will result in your termination as an Independent Business Associate. The Company plans to develop and provide to Business Associates and Customers new marketing materials which are in full compliance with the Preliminary Injunction.
You Must Immediately Alert all Business Associates and Customers in Your Down line of these Restrictions
As you were previously advised, if you are an Independent Business Associate with a downline, you must immediately advise the downline to cease all unauthorized marketing efforts for the product. You must do so immediately by e-mail, fax, U.S. Mail, or telephone depending on how you normally communicate with them.
You Must Read and Comply with all Terms of the Preliminary Injunction

17 July 2002 -- In this article, by Edmond Jacoby writer for the North County Times in Carlsbad, CA., it looks like the FTC is going to be hard on Sea Silver. The FTC settlement would make each consumer acknowledge a disclaimer that says previous claims are not supported by clinical studies. Distributors will be responsible for making sure the disclaimer is acknowledged. This may be a better when the FTC whacked New Vision and required them to give disclaimers like this to all new distributors before they signed up. ORIGINAL FTC COMPLAINT FILED
On Friday, June 13, 2003 the Federal Trade Commission ("FTC") filed a Complaint in the United States District Court in Nevada against Sea Silver USA, Inc. and Americaloe, and certain of their corporate officers. The suit claims that Sea Silver has made false claims about the benefits of its products in marketing materials and on product labels. The FTC also applied for and was granted a Temporary Restraining Order ("TRO"), which prohibits Sea Silver from selling or distributing its product without significant changes to the labeling and marketing materials.
As part of the TRO, the Court has appointed Thomas W. McNamara as Temporary Receiver for both companies. The Temporary Receiver is a neutral party who serves as an agent of the Court. Over the next several days, The Receiver and his staff will be examining the business in detail and reviewing plans to respond to and deal with the matters raised by the FTC. In the interim, the company has substantially curtailed operations. We will provide further updates on the website.
